Government responds to report on judicial compensation

Edmonton ...Government has accepted the 2006 Judicial Compensation Commission (JCC) report that recommends judges receive modest pension adjustments and maintain their salaries at the current level for the next three years.

Commissioner John M. Moreau, QC, made the recommendations after reviewing separate submissions from the government and the Alberta Provincial Judges Association. Both of those submissions suggested modest pension adjustments with no increase in salary.

The commissioner further recommended that long-term disability benefits be based on 70 per cent of the current salary, rather than 70 per cent of the pre-disability salary.

All 140 provincial court judge positions, including full and part-time judges and supernumeraries, as well as seven Masters in Chambers positions, will be covered by the new compensation arrangement. The current judicial salary level is $220,000 annually.

An Order in Council formally recognizing the new arrangement was signed October 25. Also, the government and the Alberta Provincial Judges Association have resolved the legal dispute over judicial salaries and benefits for the 2003-2006 period.

Alberta's compensation process for Provincial Court Judges and Masters is governed by Alberta's Judicature Act. The process was created to ensure both fairness and judicial independence. The next review will be in 2009.
